Aram Privacy Policy

As of the 25th of may 2018 the Algemene Verordening Gegevensbescherming (AVG) has gone into effect. We remain careful in our handling of personal information and would like to inform you in a clear and transparant manner with regards to this issue. We have set our privacystatement in accordance with the new regulations.

If you choose to voluntarily provide us with information we will use this information in accordance with our privacy policy. Aram Group BV is convinced that the private lives of our kandidates, employees as well as other relations and visitors is of utmost importance. Personal information will be handles with the highest of care and security in accordance with the AVG

Who are we?

Aram Group BV is established in Capelle a/d IJssel, Rivium Quadrant 60, postcode 2909 LC and together with it’s subsidiaries that are active under the Aram name it is responsible for processing acquired information (responsible party as meant in the AVG).

Personal information and cookies

In general our website can be visited without any of your personal information being sent to us. Similarly to many other websites our website collects certain information like Internet Protocol (-IP) address about users automatically. The IP-adres of your internet Service Provider, date and time of access tot the website, the website from where you were redirected to our site, your operating system, parts of the website you visit, the pages you visited and the information you viewed, information on the type of machine you used to visit the website, the geo-location you are located and the materials you send and download from are website. This technical information is used by the webmaster and administrator to improve website usability. 

Aram uses cookies and web statistics. We do this to determine how visitors use our website. This information helps improve out website. A cookie is a file that is saved on your computer. During a next visit these cookies can be recognized. More information can be found in the cookie declaration. 

When do we collect personal information?

We collect information from people that are about to start work with Aram or work for Aram. We collect you information from the moment you fill in your information on the website, you visit our office or sign up are being signed up to use any of our services. We can also collect your information if you have posted this on any public medium which could indicated that you would be interested in work related services. In those cases we will approach you to probe your interest to sign up in accordance with our terms and conditions taking your privacy statement into account. When your are not interested then we will record the relevant information to comply with your wish not to be approached. 

Why do we collect personal information?

We process personal information when needed to execute agreements or in case of a legitimate interest. We collect en process your information to perform HR-services including, consultancy, secondment, payroll, hiring independent contractors, recruitment, advice services, personal development and availability and personell management. 

More specifically, your personal information is processed to:

  • to be able to make you offers and/or to provide information about the services and otheractivities and to better tailor these to your wishes and qualities, this is done by our employees and partly automated (for example with a vacancy alert);

  • to approach you for commercial offers, newsletters and promotions that may be of interest to you,
    only if you have registered for this (opt-in);

  • to be able to assess your suitability and availability in connection with mediation for permanent or temporary work or an assignment, whereby use can also be made of test results, reference checks, social media (if this is relevant for the position and is indicated in the vacancy text);

  • to enter into and maintain an employee or personnel/mediation relationship or assignment with you and to carry out the relevant administration for this;

  • to be able to record an assignment with the client in an agreement with the client and to maintain and fulfill the agreement with the client;

  • to process data on behalf of our clients in the context of a pre-employment screening;

  • to promote your personal development and employability, including training, education and testing;

  • for management purposes including management information, providing internal controls and business security and conducting
    audits and auditing 
    quality purposes such as certification;

  • to apply for subsidies, premium discounts, etc.; and/or

  • if we have entered into an employee or personnel/mediation relationship with you, for legal and regulatory compliance, including but not limited to identification, labor law, tax and social security law, anti-fraud and national and international sanctions laws.

What personal information do we collect?

We process personal data to the extent necessary for the execution of agreements or on the basis of a legitimate interest. Additional data may be desirable to better tailor the service to your wishes and qualities or to meet more specific questions or obligations from clients. You are responsible for the correctness and relevance of the data you provide. More specifically, this concerns – among others and insofar as applicable – the following (documents containing) personal data:

at Signup

  • NAW data, e-mailadres and contact information
  • Birthdate, age and gender
  • curriculum vitae (CV), information about education, internships and work experience
  • data on training and education and/or examinations that were followed through Aram or independently
  • data on availability and leave
  • other information that can be of importance for determine a candidates capabilities, for example references and recommendation letters
  • pass photo and video (introduction) – on voluntary basis 

When you start working, are working and have worked for Aram

  • nationality, BSN-number, ID, work permit
  • remaining data related to personnel, payroll and (sick)leave registration
  • payments for performed work in service of Aram
  • in some cases we collect data as part of a pre-employment screening upon request of our clients

If and when you are going to work/are working/have worked for Aram as an independent contractor the mention data is only processed when relevant and required. In case of an independent contractor we also process company data.

Aram only processes specific personal data when this is required to comply with the law, if and when there is permission to do this or it is allowed by law. With specific personal data the following is implied; race, religion or life philosophy, political inclination, health, sex life, union membership, criminal history and or data on unlawful or unwanted behavior. 

With whom could we share your information (candidates or contractors)?

Aram can share your information within the varying Aram entities, it’s clients, subcontractors providing services for Aram, suppliers, governmental entities and business relations and all other occasions we can be forced to do so by court order or sanction. Providing personal information happen when there is a justified cause, lawful mandate and/or in accordance with our goals named in “Why do we collect your personal information”. Your personal data can be distributed outside the Netherlands. Aram has taken measures to ensure that the distributed information is adequately protected. 

How long do we save your personal data?

The duration for saving your data is dependent upon the applicable lawful terms. 

Candidates

Your personal data (ex. NAW, CV, work experience, education, test results etc.) are available till two years after last contact if you are not employed by Aram. One year and two years after contact with Aram you will be informed that you are signed up in our system.

If you do not want to use our services you can request to be signed out through your Aram contact. You will then not be contacted. Your personal data will be removed definitively after three months (within recruitment your data will be available longer related to claim risk’s)

when you work or have worked for Aram

Your personal data will be available for two years after ending your employment. Certain information will be available longer in relation to claims, audits and fiscal responsibilities. 

If you do not want to use our services you can request to be signed out through your Aram contact. You will then not be contacted. Your personal information will only be available for Aram in accordance with the applicable goals and terms. 

Personal information of business relations

 Aram processes the personal data of relations that work for companies with which we do business (1) to make offers for and/or provide information about the service and other activities and (2) to maintain a business relationship and (3) to establish a business relationship and (3) to conclude and maintain the assignment agreement. We also have the following personal data of business relations: names, contact information and positions of contact persons.

Aram can pass on the personal data obtained from its business relations if this is necessary to achieve the objectives of the business relation or for the purpose of mediation. This data may be passed on to other Aram entities, to job applicants or candidates, business partners and subcontractors (eg data processors) who provide services on its behalf, and in all other cases where Aram may be obliged to do so, for example by a court order. Personal data can be transferred outside the Netherlands. Aram has taken the necessary measures to ensure that all personal data transferred is adequately protected.

Your rights

Candidates, independent contractors and business relations:

If you have your own account, you have access to a large part of the personal data registered about you. If you wish to view your total personal data processing and/or want to change or delete data that you cannot adjust yourself, you can contact your contact person at Aram.

for remaining relations:

You have the right to view and change your registered personal information. For this end you can contact your Aram contact person.

Security

Aram does everything it can to optimally protect your personal data against unauthorized use. We do this on the basis of physical, administrative, organizational and technical measures. For example: only authorized persons have access to the data. If and insofar as data is provided to data processors who provide services or carry out assignments on its behalf, Aram has agreed with them that they also optimally protect the personal data.

If there (a suspicion of) a data breach, we request that you report this immediately via 010-2707000. Provide name, contact details and a description of the situation.

Changes

Aram may make changes, additions or amendments to its privacy policy from time to time for a variety of reasons. The most current privacy policy can be viewed at all times on the Aram website. This version was drawn up in September 2020.
